PEZA Visa (47a2) for Foreigners in the Philippines

The PEZA Visa or special non-immigrant visa is issued by the Department of Justice (DOJ) to foreign employees of Regional Headquarters, Regional Operating Headquarters, or those who work for special projects in economic zones as allowed under Sec. 47A2 of the Philippine Immigration Act. 

The PEZA Visa is made for foreign workers employed by industries invested in the public interest and/or engaged in infrastructure, oil exploration, and power generation. 

Under Sec. 47 (a)(2) of the Philippine Immigration Act, a PEZA Visa can be issued to foreign investors by the Department of Justice (DOJ) based on public interest or public policy considerations. The PEZA Visa may also apply to foreign nationals and/or non-resident aliens gainfully employed by ecozone enterprises inside PEZA-registered ecozones and their qualified dependents.

What are the advantages of a PEZA visa?

  • The 47a2 or PEZA visa allows the family members of the visa holder to stay for the duration of the foreign national’s visa, which conforms to the foreign worker’s employment contract, or for a maximum period of two (2) years. 
  • Compared to the 9G visa, the 47a2 or PEZA visa does not require its visa holder to pay exit clearances whenever he leaves the country. He is also exempted from ACR-I card requirements.

Who is eligible to apply for a PEZA Visa?

  • Applicants approved by the President or their Department are eligible for a 47a2 visa under the provisions stated in CA No. 612, as amended.
  • Dependents traveling with any of the types mentioned above of visiting workers.
  • Employees of companies registered with the Authority of the Freeport Area of Bataan (AFAB), the Board of Investments (BOI) or the Philippine Economic Zone Authority (PEZA). 
  •  Foreign professors, researchers, scholars, trainees, fellows, and students under sponsorship from locally or internationally accredited organizations focused on cultural, charitable, relief, and scientific projects.

PEZA Visa (47a2) Requirements:

  • Below are the documentary requirements for securing a PEZA visa:
    • Valid passport/s of foreign national/s including those of any dependent/s traveling with them.
    • Re-entry permit/s to the port of embarkation or country of origin if required by the Department of Justice (Bring originals as well as photocopies)
    • Marriage contract for the dependent spouse
    • Birth certificate/s of dependent children
    • Affidavit of support and guarantee of return fare by the applicant or sponsor if spouse or dependent/s is included in the application. 
  • Government agency requirements:
    • Board of Investments (BOI)
      • Application form (BOI);
      • Affidavit of support from BOI-registered company;
      • Authenticated passport with a valid visa;
      • A Secretary’s Certificate authorizing the application for the Special Non-Immigrant Visa (for elective officers);
      • An Understudy Information Sheet, Designation of Understudy, and Understudy Training Program (if applicable);
      • Duly signed an undertaking in the form of Board of Resolution;
      • Company organizational chart; and
      • Resume and bio-data of the foreigner applying for the visa.
    • PEZA
      • A letter of request on behalf of the company;
      • Authenticated passport with a valid visa;
      • A Secretary’s Certificate authorizing the application for the Special Non-Immigrant Visa (for elective officers);
      • Current service contract;
      • Resume and bio-data of the foreigner applying for the visa
    • DOJ
      • Application form (DOJ);
      • Affidavit of Support from BOI/PEZA registered company;
      • Authenticated passport with a valid visa;
      • A Secretary’s Certificate authorizing the application of the Special Non-Immigrant Visa (for elective officers);
      • Current Service Contract (for non-elected positions)

How do I apply for a PEZA Visa?

  • Submit the requirements and apply to the government agencies BOI, DOA, and PEZA;
  • Wait for the government agency to endorse the application to DOJ;
  • After approval from the DOJ, it endorses the application to the BI for implementation;
  • After evaluation and verification, the PEZA-registered company will apply for the PEZA visa on behalf of the applicant to the PEZA zone administrator or manager of the ecozone where the company is situated.
